What is a grant of representation?

A grant of representation is a document which gives you the legal right to deal with the estate of a person who has died. If the deceased person left a will, the people named in the will as executors will normally apply for what is known as a grant of probate to deal with the estate. If there is no will, the next of kin will normally apply for what is known as grant of letters of administration. The general term for both of these documents is a grant of representation.

What does a grant of representation allow me to do?

A grant of representation allows you to deal with the estate of the person that has died. This allows you to collect in money from bank accounts and allows you to sell property. You will also need to pay any inheritance tax that is due and pay any debts that the deceased person had. Finally, you will need to share out the remaining estate in line with the will or the intestacy rules where there is no will.

A legal service provider will help you to apply for the grant of representation at your local probate registry and will offer advice on how to pay inheritance tax if this applies.

Can more than one person obtain a grant?

If there is a will, the person that died may have named more than one person to deal with the estate and they can all apply for a grant of probate. If there is no will, it is possible for more than one person to apply for a grant of letters of administration. There is a set order of people who can apply usually beginning with the husband, wife or civil partner of the deceased.
