What else you might like to know about Money Disputes

Money matters such as financial disputes can often require specialist skills and knowledge. Here is some basic advice and guidance to help inform your choice of legal service provider.

Who can I make a claim against?

You can apply to claim money you are owed by a person or a business. A legal service provider can advise you on the best options available to you.

What are the criteria for making a claim?

You are eligible to make a claim if you believe that you are owed money, a product or a service by another party. A legal service provider is well placed to advise on the circumstances of your case and clarify the strength of your claim.

How do I pursue a claim?

You may wish to consider mediation, as it could be quicker and cheaper than going to court. If it is not possible to reach an agreement by mediation, it is likely that you will need to issue court proceedings. Your legal service provider will be able to advise on you on the best options available to you.

When should I not make claim?

It is probably not worth making your claim through a a legal service provider if your claim is worth £10,000 or less. This is because a large amount of any money you win will be lost on legal fees. And if you lose, you could be left seriously out of pocket.

However, you are still able to claim the money you are owed. If you are claiming against a business or organisation, you should first check to see if they have an Ombudsman scheme – this will mediate to help resolve your dispute. If they do not have an Ombudsman scheme, or you are claiming against a person, you should make your claim through the Small Claims Court.

How should I choose a legal service provider?

When choosing a legal service provider you should look to appoint a professional with adequate experience in money disputes. You may wish to consider reviews and ratings from existing clients, as well as factors such as location, reputation and cost of a firm before making your decision.
